Full Federal Court decides “flushable wipes” appeal

On Monday 15 June the Full Federal Court published its decision to dismiss an appeal brought by the Australian Competition and Consumer Commission against Kimberly Clarke Australia, the sellers of a popular "flushable" wipes product. The proceedings and appeal, in which three Banco barristers appeared, concerned the operation of the Australian Consumer Law in relation to whether the "flushable" wipes product could be marketed as “flushable.” 

John Sheahan QC and Jonathon Redwood were briefed by King & Wood Mallesons to appear for Kimberly Clark Australia, the Australian subsidiary of Kimberly Clark, the world’s largest producer of personal hygiene products. Danielle Forrester appeared for the ACCC.
